Terms & Conditions

These Terms and Conditions (the “Agreement”) govern the rental of high-end vehicles from Fojo LLC DBA Impavido Exotics (“Owner,” “we,” or “us”), a New Jersey limited liability company with offices in Berkeley Heights, NJ, to you (“Renter,” “you”). By renting a vehicle, you agree to be bound by these terms.

This Agreement is the entire agreement between Renter and Owner and may only be modified in writing signed by both parties.

Definitions

“Vehicle”: The high-end vehicle listed in the Rental Agreement Summary, or any replacement vehicle.
“Rental Agreement Summary”: The document specifying the Renter, Vehicle, rental period, and charges, signed by Renter.
“Rental Period”: The time from when Renter takes possession of the Vehicle until it is returned and checked in by Owner.
“Additional Authorized Driver (AAD)”: Any individual, approved by Owner, permitted to operate the Vehicle, listed in the Rental Agreement Summary.
“New York Tri-State Area”: New York, New Jersey, and Connecticut.
“Optional Accessories”: Additional items (e.g., GPS, toll transponders) accepted by Renter.

Eligibility and Verification

Renter must be at least 25 years old and hold a valid driver’s license with no restrictions or outstanding warrants.
Renter must provide proof of comprehensive and collision insurance with minimum coverage of $100,000 per person/$500,000 per accident for bodily injury and 1,000,000 for property damage.
Owner may verify Renter’s personal, credit, and insurance information through credit agencies or other sources. Renter authorizes such verification.
AADs must meet the same eligibility criteria and be approved by Owner in writing.

Vehicle Use Restrictions

The Vehicle may only be used in the New York City Area unless Owner provides prior written approval.
Renter and AADs shall not:
- Allow unauthorized drivers to operate the Vehicle.
- Use the Vehicle for illegal activities, racing, towing, off-road driving, or commercial purposes (e.g., ridesharing, transport for hire).
- Smoke or vape in the Vehicle (results in forfeiture of deposit and a $500 cleaning fee).
- Alter, modify, or tamper with the Vehicle or Optional Accessories.
- Carry passengers under 7 without a federally approved child restraint system.
- Exceed the Vehicle’s gross vehicle weight rating or carry hazardous materials.
- Operate the Vehicle while impaired by alcohol, drugs, or other substances.
Renter must use premium fuel (as specified in the Rental Agreement Summary) and maintain the Vehicle in pristine condition.

Vehicle Condition and Return

Renter acknowledges the Vehicle and Optional Accessories are in excellent condition at the start of the Rental Period, having inspected or had the opportunity to inspect them.
The Vehicle is provided “as is” with no warranties, express or implied, including merchantability or fitness for a particular purpose.
Renter must return the Vehicle to the designated location by the date specified in the Rental Agreement Summary, in the same condition (ordinary wear excepted), with the same fuel level and type.
If the Vehicle is returned with less fuel, Renter will be charged at $15 per gallon for refueling.
Late returns incur a fee of $250 per hour, up to the full daily rate for each 24-hour period.

Payment and Fees

Renter shall pay:
- Rental charges (daily, weekly, or monthly) as specified in the Rental Agreement Summary.
- A security deposit of $1,000 (or higher, based on Vehicle value), refundable within 15 business days after return, less any deductions for damages, fees, or violations.
- Mileage fees for miles exceeding the allowance (e.g., 100 miles/day) at $4 per mile.
- Optional Accessories charges, if applicable.
- A $10 Toll Pass Fee ( tolls are deducted from the deposit).
- A vehicle cost recovery fee to cover licensing, registration, and repossession costs.
Additional charges include:
- $500 for unauthorized returns to a non-designated location, plus $4 per mile to the original rental office.
- Fines, tolls, parking, towing, or violations incurred during the Rental Period, plus a $100 administrative fee per incident.
- Collection costs, including attorney fees, if Owner must recover amounts owed.
Renter authorizes Owner to charge credit/debit cards for all amounts owed, including if third-party billing is declined.

Damage, Loss, or Theft

Renter is responsible for all damage to, loss, modification, or theft of the Vehicle or Optional Accessories, regardless of fault, including repair costs, diminished value, and loss of rental income.
Renter must report any incident to Owner and within 24 hours and cooperate fully with Owner’s investigation.
Owner may retrieve data from the Vehicle’s event data recorder, and Renter consents to its use.

Termination of Use

Owner may terminate Renter’s right to use the Vehicle for any violation of this Agreement without notice.
Owner may seize the Vehicle without legal process and report it stolen if used after termination. Renter waives claims for damages from such actions and remains liable for all charges.

Insurance and Indemnity

Renter’s insurance is primary and must cover the Vehicle’s full replacement value (up to $250,000 for high-end vehicles).
Renter shall indemnify, defend, and hold Owner harmless from any claims, damages, or liabilities arising from the Vehicle’s use, including fines, tolls, or third-party claims.

Governing Law and Disputes

This Agreement is governed by New Jersey law.
Disputes shall be resolved in courts located in Union County, New Jersey. Renter consents to this jurisdiction.

Miscellaneous

Renter is not an agent of Owner and has no authority to bind Owner.
If any provision is unenforceable, the remaining provisions remain in effect.
Owner may assign this Agreement; Renter may not.
